Welcome to BugSense. By accessing or using our website bug detection service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you (either an individual or entity) and BugSense ("we," "us," or "our"). Your continued use of the Service constitutes acceptance of these Terms and any future modifications.
2. Description of Service
BugSense is a Software-as-a-Service (SaaS) platform that provides automated website bug detection and monitoring. Our Service includes:
- Automated website scanning and testing
- Bug detection and analysis powered by AI
- Screenshot capture of detected issues
- Bug tracking and management dashboard
- Email notifications and alerts
- Bug history and reporting tools
3. Account Registration
To use BugSense, you must create an account. By creating an account, you agree to:
- Age Requirement: You must be at least 18 years old to use the Service
- Accurate Information: Provide accurate, current, and complete information during registration
- Secure Credentials: Maintain the security of your password and account credentials
- Account Responsibility: Accept responsibility for all activities that occur under your account
- Unauthorized Access: Notify us immediately of any unauthorized access or security breach
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

- Screenshot capture included

- Agency Plan - $99/month:
- Unlimited websites
- 500 scans per month
- Screenshot capture included
- Advanced AI analysis
- Unlimited bug history
- Priority email support
- Team collaboration features
Payment Terms
All payments are processed securely through Stripe. By subscribing to a paid plan:
- You authorize automatic monthly billing on your subscription renewal date
- You agree to provide valid and current payment information
- You acknowledge that fees are billed in advance on a monthly basis
- You understand that we may change pricing with 30 days' advance notice
Cancellation and Refunds
- You may cancel your subscription at any time through your account settings
- Upon cancellation, you retain access until the end of your current billing period
- No refunds are provided for partial months or unused services
- After cancellation, your account will revert to the Free plan
- All data will be retained according to your plan's bug history limits
5. Acceptable Use
You agree to use BugSense only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Scan or test websites that you do not own or have explicit permission to test
- Use the Service for any illegal, unauthorized, or malicious purpose
- Attempt to circumvent usage limits, access controls, or security measures
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts or bots to abuse the Service
- Interfere with or disrupt the Service or servers
- Upload malicious code, viruses, or harmful content
- Violate any applicable laws or regulations
- Collect or harvest data from other users
- Use the Service to compete with BugSense
Violation of these acceptable use terms may result in immediate termination of your account and legal action.
6. Intellectual Property Rights
Our Intellectual Property
The Service, including all software, code, designs, logos, and content, is owned by BugSense and protected by United States and international copyright, trademark, and intellectual property laws. All rights are reserved.
Your Content
You retain all ownership rights to the websites you test and the data you provide. By using the Service, you grant us a limited license to:
- Access and scan your websites for bug detection purposes
- Store bug reports, screenshots, and test results
- Process your data to provide and improve the Service
This license terminates when you delete your account or remove a website from monitoring.
7. Service Availability
BugSense is provided on an "as is" and "as available" basis. While we strive to provide reliable service, we cannot guarantee:
- 100% uptime or uninterrupted access to the Service
- Error-free operation or bug-free software
- That the Service will meet your specific requirements
- The accuracy or completeness of bug detection results
- That defects will be corrected immediately
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We may also perform scheduled maintenance that temporarily interrupts service availability.
8. Data and Privacy
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using BugSense, you consent to our data practices as described in the Privacy Policy, including:
- Collection of account information and usage data
- Storage of website URLs, bug reports, and screenshots
- Use of cookies for authentication and functionality
- Sharing data with service providers (Stripe, hosting, email)
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BugSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- This includes loss of profits, data, revenue, or business opportunities
- We are not liable for damages arising from your use or inability to use the Service
- We are not responsible for third-party websites, services, or content
- Our total liability to you shall not exceed the amount you paid us in the 12 months preceding any claim
Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless BugSense, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your use of the Service
- Scanning websites without proper authorization
- Any content or data you submit to the Service
11. Termination
Termination by You
You may terminate your account at any time by:
- Canceling your subscription through account settings
- Using the "Delete Account" option in settings
- Contacting our support team
Termination by Us
We may terminate or suspend your account immediately, without notice, for:
- Violation of these Terms or our Acceptable Use policy
- Fraudulent, illegal, or abusive activity
- Non-payment of fees for paid subscriptions
- Extended periods of account inactivity
Effect of Termination
- Upon termination, your right to use the Service immediately ceases
- Your subscription (if any) will be canceled without refund
- Your account data will be deleted within 30 days of termination
- We may retain certain data for legal, tax, or regulatory purposes
12. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last updated" date at the top of this page
- For significant changes, we will notify you via email to your registered address
- Your continued use of the Service after changes constitutes acceptance of the new Terms
- If you do not agree to the modified Terms, you must stop using the Service

13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BugSense regarding the Service.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor or affiliate.
